How the SHOP SAFE Act Might Change the Ecommerce Counterfeiting Liability Landscape

Arent Fox Partner Jim Davis was recently quoted in a World Trademark Review article titled “How the SHOP SAFE Act might change the ecommerce counterfeiting liability landscape.”

The article explored the new SHOP SAFE Act which was recently introduced to the US House of Representatives. Jim reflected that “While the act imposes additional burdens and liability on ecommerce sites, it is intended to benefit the general public and address a serious and growing problem.” However, Jim noted that while “no reputable ecommerce company would knowingly sell counterfeit goods or support counterfeiters… some online retailers may be a little uncomfortable knowing that the SHOP SAFE Act would create statutory obligations and liability for what is a pervasive and growing problem”
