Private Clients, Trusts & Estates Partner Sarah Kerr Severson was quoted in Family Wealth Report on the implications of artificial intelligence (AI) notetaking tools for confidentiality and attorney-client privilege.
While recognizing that AI can be a valuable tool for summarizing and collecting data, Sarah cautioned that materials generated by these tools may create legal risks. She explained that documents are “discoverable” in litigation, noting that automated transcripts and summaries are considered digital documents that could be subpoenaed by opposing counsel in civil or criminal proceedings.
Sarah added that “AI does not owe clients a duty of confidentiality or accountability,” emphasizing the importance of attorneys disclosing AI use to clients through engagement letters. According to Sarah, cloud-based processing, third-party vendor access to data, and terms of service that permit model training can undermine the legal expectation of confidentiality.
