CPSC Border Detention & Product Seizures
The Consumer Product Safety Commission (CPSC), in collaboration with Customs and Border Patrol (CBP), has broad authority to order the detention and seizure of goods that it believes to be non-compliant with CPSC safety regulations. Customs brokers can be unfamiliar with these regulations and unable to help importers interpret detention notifications and interface with CPSC personnel about the alleged infractions.
At the moment, CPSC enforcement is particularly aggressive on children’s clothing, consumer products perceived to be of interest to children, and compliance with flammability regulations.
ArentFox Schiff helps importers understand what has happened and what, if anything, can be done about it:
- Submission of appropriate certifications and proof of compliance;
- Release of detained products pending review to minimize storage charges;
- Repairs / rework of non-compliant products to avoid seizure;
- Advice regarding seizure for non-compliant products.
