Counsel

Spencer represents ArentFox Schiff clients in complex trade matters, with a focus on antidumping and countervailing duty proceedings, statutory tariff measures, customs, and trade policy issues.

Before joining ArentFox Schiff, Spencer was an attorney advisor in the Office of the General Counsel at the US International Trade Commission, where he argued before the US Court of International Trade and the US Court of Appeals for the Federal Circuit in several high-profile appeals. He also advised the Commission in dozens of antidumping, countervailing duty, and safeguard proceedings. 

Spencer previously was an associate at a large law firm, where he represented domestic manufacturers, importers, and foreign producers as petitioners’ and respondents’ counsel in antidumping, countervailing duty, and safeguard investigations. His experience also includes advising on other trade remedy proceedings and statutory tariff measures implemented under Section 301 and Section 232, the Miscellaneous Tariff Bill, and the Generalized System of Preferences, as well as customs issues. He has also advised clients on US trade policy and engaged with congressional stakeholders on related matters.

Spencer also held roles within the US Department of Commerce’s International Trade Administration, where he worked on antidumping and countervailing duty investigations and policy matters. He also served as a judicial intern to the Hon. Evan Wallach of the US Court of Appeals for the Federal Circuit.

Client Work

  • Represented clients in antidumping, countervailing duty, anti-circumvention proceedings and safeguard proceedings under Section 201 before the US International Trade Commission and US Department of Commerce. 
  • Litigated international trade disputes US Court of International Trade, and US Court of Appeals for the Federal Circuit.
  • Provided guidance on trade policy issues involving duties, quotas, and other special import restrictions, including Section 232 and Section 301 duties.
  • Successfully assisted clients to obtain exclusions and exemptions from Section 232 and Section 301 duties and obtain general duty exemptions under the miscellaneous tariff bill.
  • Assisted clients by tracking and analyzing international trade legislation and administrative policy enacted by Congress and the Office of the US Trade Representative. Represented major domestic and multinational producers and US importers in various industries including steel and aluminum, pipe and tube products, petrochemical products, textile products, chemical products, composite materials, and food and agricultural products.

Life Beyond the Law

Outside of work, Spencer enjoys spending time outdoors with his spouse and toddler through hiking, cycling, and gardening. He also enjoys playing the mandolin, cooking, and baking—although he will never live up to the standards set by his family of professional chefs. Spencer is also in the process of indoctrinating his toddler into Kansas Jayhawks Basketball.
