Marsh Quoted on Jury Verdict Invalidating Ugg Boot Design Patent

New York Fashion & Retail and Consumer Products Partner Michelle Mancino Marsh was quoted on the California federal court jury verdict in Deckers v. Quince that determined if the well-known online retailer had infringed on Deckers’ design patent for a style of its famous Ugg boots.

While the jury decided that Quince’s boots did, in fact, infringe on Deckers’ design patent, they also decided that said patent was invalid.

Michelle said that the verdict affirms Quince’s “chip-away style defence, which succeeded in eliminating every claim made by Deckers” over the course of the litigation.”

“There will be plenty of lessons from the post-mortem on this litigation,” she added. “In particular, this verdict should encourage brands to fortify their IP portfolios and their evidence before they even step into a courtroom.”
