Beginning June 21, 2022, U.S. Customs and Border Protection (CBP) will apply a rebuttable presumption that goods produced in whole or in part in the Xinjiang Uyghur Autonomous Region (XUAR) of China or identified entities are prohibited from importation into the United States. The UFLPA will have far-reaching consequences for U.S. importers and can result in the detention of merchandise at the border. Many of you are questioning: What can our company do to prepare for enforcement of the UFLPA? How can we conduct effective supply chain due diligence? What information will CBP require to satisfy the “clear and convincing” evidence standard? How does this differ from the Withhold Release Order process?
