Bulger Quoted on Top Copyright Cases to Watch in 2026

AI & Emerging Technologies Industry Group Co-Leader Danielle W. Bulger was quoted on one of Law360’s top copyright cases to watch this year that could reshape copyright law in the age of artificial intelligence (AI).

The US Supreme Court heard a petition from computer scientist Stephen Thaler, who argued that the Copyright Office incorrectly imposed a human-authorship requirement not found in the Copyright Act when it refused to register his AI-created artwork.

Danielle said that this case gets to the heart of the intersection of intellectual property and AI.

“This petition presents a foundational question for the AI era: whether a work generated without a direct traditional human author can ever be protected under the current Copyright Act,” she said. “And I think it’s one case that we’re watching because ultimately that answer could shape registration practice, licensing and enforcement strategies across industries.”
