Fiorentino Quoted on CIPA Litigation Following SB-690
Privacy Daily
Partner Lynn Fiorentino was quoted on the continued California Invasion of Privacy Act (CIPA) litigation following the signing of SB-690, which removes the private right of action for pen register and trap-and-trace claims.
Lynn said she has not yet seen many of the claims barred by SB-690 voluntarily dropped or dismissed, while plaintiffs are beginning to pursue other claims that remain available.
“I haven’t had very many” of the claims barred by SB-690 “dropped or dismissed voluntarily yet,” Lynn said. But she noted that she has been seeing CIPA plaintiffs “pivoting” to other claims that are still allowed.
Some plaintiffs have said they will not dismiss the barred claims until SB-690 takes effect January 1, Lynn also said there “probably” will be a legal challenge to the law’s two-year retroactivity clause.
