Kim Quoted on Uptick in Tariff Refund Lawsuits

International Trade Partner James Kim was quoted on the sharp increase of tariff refund lawsuits filed by importers in the US Court of International Trade.

While companies can receive a tariff refund through the US Customs and Border Protection’s (CBP) system, entries that were finalized by CBP more than 80 days ago cannot be issued a refund without a lawsuit. The trade court responded by issuing court orders to plaintiffs. 

“The timing fits” for a surge in lawsuits, James said. “The court is now, in a sense, playing ball with the government.”
