Jay Hulme and Matthew Wright Featured in Law360 Discussing Recent Discovery Ruling in Ongoing Antitrust Matter
In the ongoing litigation matter, US District Judge Rosemary M. Collyer “ordered three Brazilian ferrosilicon producers to explain how they arrived at their calculations of the lost profits in the antitrust case, which accuses US ferrosilicon companies [CC Metals & Alloys Inc., Elkem Metals Inc., and Applies Industrial Materials Corp.] of conspiring to file fraudulent anti-dumping petitions with the US International Trade Commission.” Judge Collyer declared that the US companies’ request was routine and sought information “vital” to their defense.
Mr. Hulme stated, “We believe that when those [lost-profit] calculations are exposed to the light that it will be evident that the plaintiffs — which were found to have sold ferrosilicon at less than cost — suffered no damage from the temporary imposition of customs duties, all of which were refunded.”
