Kim Quoted on Uncertain Future in Fight for Tariff Refunds

Partner James Kim was quoted on the uncertain future of the Trump Administration’s attempt to avoid paying back billions in illegally collected tariffs.

The US Court of International Trade’s (CIT) April ruling directed the Trump Administration to issue refunds to all the companies that paid the now-defunct tariffs. In June, the US Department of Justice (DOJ) appealed the ruling, arguing that CIT exceeded its authority. 

“That issue could really go both ways,” James said, “the DOJ has good arguments” that the Supreme Court decision regarding federal court injunctions also applies to the CIT. 

He added, “Despite what Judge Eaton has said on that — it’s going to be interesting to see how this plays out.”
