Positive Employee Relations & Compliance
We advise employers on developing a positive employee relations approach and assist them during union organizing campaigns. Some of this work involves helping employers draft and enforce workplace policies that comply with the National Labor Relations Act (NLRA) and do not violate employee rights to engage in protected concerted activities. We also train managers on NLRA compliance.
Collective Bargaining & Contract Administration
For our clients who are unionized, we assist with preparation for collective bargaining, negotiations (both at and away from the bargaining table), and contract administration. When disputes develop, we guide our clients through the grievance procedure and represent them in arbitrations.
Picketing & Strike Response Strategies
If clients experience picketing or strikes, we help them develop effective response strategies, including maintaining operations during a labor dispute. This often involves seeking emergency injunctive relief.
NLRB Representation & Defense
We have vast experience representing clients in matters before the National Labor Relations Board (NLRB). This frequently involves defending employers against unfair labor practice charges for alleged violation of Section 7 rights, discrimination based on union activity, and refusal to bargain in good faith. It also involves representing clients in representation proceedings, whether for potential certification or decertification of a union.
Mass Layoffs & Plant Closings
When unionized companies need to implement a mass layoff or a plant closing, we help them navigate any notice requirements under the federal Worker Adjustment and Retraining Notification Act and any state or local equivalents. We also engage in effects bargaining on their behalf.
