Brian counsels clients through all stages of patent prosecution, from invention disclosure and prior art analysis through application drafting, prosecution strategy, and post-issuance portfolio management.
His practice spans utility and design patents in telecommunications, software, medical devices, and consumer electronics. He regularly prepares and prosecutes complex patent applications, drafts patentability, invalidity, and non-infringement opinions, and conducts detailed freedom-to-operate analyses to guide clients’ product development and commercialization decisions. Brian also represents clients in litigation before the US District Courts and the US International Trade Commission.
Brian is particularly recognized for his extensive design patent practice, where he advises on design patent procurement, portfolio development, and enforcement, including leveraging design patents in ITC investigations and federal court litigation. He reviews and negotiates licensing agreements, evaluates intellectual property portfolios for acquisition and investment purposes, and performs IP due diligence in connection with corporate transactions. Brian also manages post-grant proceedings, including inter partes review and post-grant review strategies.
Previous Work
Before joining ArentFox Schiff, Brian worked at the United States Patent and Trademark Office (USPTO). It was there that he examined patent applications for digital and pulse communication inventions specifically for telecommunications devices, including spread spectrum, repeaters, synchronizers, equalizers, bandwidth manipulation, modulation, receivers, transmitters, and transceivers. This technical examining experience provides Brian with firsthand insight into the patent examination process and a deep understanding of how to effectively advocate before the USPTO.
Brian has also served as a legal intern for Hon. Judge Susan Braden at the United States Court of Federal Claims, gaining valuable experience in government contracts and federal claims litigation.

Brian is a previous member of the American Intellectual Property Law Association and the Giles S. Rich American Inn of Courts.
Life Beyond the Law
Brian is an avid fan of Florida State Seminole sports. He also enjoys skiing, traveling with his wife and two daughters, and playing golf.
