Naples Quoted on OIG “Unfavorable Opinion” in Home Care Sign-On Bonuses

Pascal Naples was quoted on a recent “unfavorable” opinion published by the Office of Inspector General (OIG) for the US Department of Health and Human Services that sign-on bonuses for caregivers providing in-home care for Medicaid recipients would fall under the anti-kickback statute.

Pat said that despite the OIG’s opinion, staffing agencies can still use sign-on bonuses in their recruitment efforts.

“We don’t see this as a rebuke of sign-on bonuses generally, because the OIG was very clear in focusing on specific facts,” he said. “This was about a guaranteed referral, as opposed to broadly applicable recruitment benefits.”

Pat added that this move from the OIG highlights the continuing high-level of scrutiny and enforcement the healthcare industry is seeing from the current Administration.
